Foreclosure Process Overview

South Carolina is a 100% judicial foreclosure state. The lender files a Complaint in the Court of Common Pleas. A Lis Pendens must be filed no more than 20 days before the complaint AND at least 20 days before the foreclosure decree. In counties with a Master-in-Equity (23 of 46), an Order of Reference transfers the case to the MIE. A Certificate of Compliance under §29-3-100 is required. After default or hearing, a Final Judgment is entered and the property sold.

Master-in-Equity (MIE) — 23 of 46 Counties

South Carolina has 23 counties with a Master-in-Equity court. In these counties, an Order of Reference is required to transfer the foreclosure case from the Court of Common Pleas to the MIE. The MIE handles most mortgage foreclosure actions. Always verify whether your county has an MIE before filing.
