SC Lis Pendens Timing
Must be filed no more than 20 days before the complaint AND at least 20 days before the foreclosure decree (§15-11-10). Failure to comply may invalidate the proceeding.
FL Mandatory E-Filing
All attorneys must e-file through the Florida Courts E-Filing Portal (Rule 2.525). Documents must be PDF/A format. File size limit: 50 MB per document.
FL Timeshare — Non-Judicial Option
Florida §721.855 allows non-judicial (trustee) foreclosure of timeshare assessment liens — significantly faster than judicial foreclosure. Consolidated actions under §721.83 allow multiple units in one filing.
AZ Trustee’s Sale — 91-Day Rule
Arizona non-judicial foreclosures (A.R.S. §33-807) require the Notice of Trustee’s Sale to be recorded at least 91 days before the sale date. Sales conducted before 91 days are void. Anti-deficiency rules (A.R.S. §33-814) bar deficiency judgments on qualifying residential properties.
