Foreclosure Process Overview

Florida is a 100% judicial foreclosure state. The lender files a complaint in Circuit Court. After service, if no answer is filed, a default is entered. The case proceeds to summary judgment or trial. A Final Judgment of Foreclosure is entered, and the property is sold at public auction (online via county-specific vendor). The clerk issues a Certificate of Sale, then Certificate of Title after the objection period.

Florida Timeshare — Non-Judicial Option Available

Florida §721.855 allows non-judicial (trustee) foreclosure of timeshare assessment liens — significantly faster than judicial foreclosure. Consolidated actions under §721.83 allow multiple timeshare units to be foreclosed in a single proceeding. See the Timeshare Rules tab for full details.
